No. The doctor's motive is irrelevant. Rather, we have to show what the proper standard of care then show that the doctor's actions fell below that standard. It does not matter whether he did it intentionally. Of course, the more irresponsible the doctor is, the more upset he or she will make the jury and the higher the value of the case.
