Missouri Cases on Sovereign Immunity
- City of Nevada, Missouri v. Bickel (September 30 , 2008) - An electrician, employed by an electric company, installed a new electric meter at a mobile home park and installed a three-wire connection to a mobile home in violation of the National Electric Code, which had been adopted by the City of Nevada and which required a four-wire connection. The improper installation was inspected by a city inspector, which charged a $12.50 fee for the inspection. Two days later, the owner of the trailer was electrocuted. Suit was filed against the electrician, the city, and the inspector. The city and the inspector filed a motion for summary judgment, which was granted by the trial court and then appealed. The court of appeals determined that charging a fee for the inspection did not make the activity a proprietary function, but that supplying the inspection service was a governmental function designed to protect public health and safety.
